NewsflashReleased - 31 July 2025Dear Member In our late May 2025 Newsletter, we commented on the 21 July 2025 pre-trial conference as follows, “The Judge was satisfied that all reasonable efforts to contact all landowners have been made and has therefore issued an Order for Alternative Service. This means that the Land Claims Commissioner will publish a “Notice of the Land Claim” in 7 national and 2 local newspapers, together with placing physical notice boards at 4 prominent venues in the claim area, prior to the next pre-trial conference, which is scheduled for 21 July 2025. Such notices and boards will satisfy this requirement. This removes the final known obstacle for a court date to be set.” Regrettably we face yet another delay, as some members will be aware that notices were only placed at prominent venues by the Commissioner about a week prior to the July pre-trial conference and that a “Notice of the Land Claim” has yet to be published in local and national newspapers. Whilst the Commissioner was apologetic and suggested that this would be completed within a week, the Judge gave him until end August to complete this task. Frustratingly we therefore face yet another pre-trial conference, which has been scheduled for 8 October 2025. Our legal team is gearing up for this as they believe that this will be the final pre-trial conference and that the Judge will thereafter schedule a court date.
