SPECIAL GENERAL MEETING AND THE WAY FORWARD

SPECIAL GENERAL MEETING

The Special General Meeting (SGM) was held on 18 January 2025 at Allengeni Conferences and Wedding Venue, Plot L 63 Leeuwenkloof at 10H00. We would like to thank those that attended or provided a proxy for this important meeting. Pleasingly, in excess of 90 members were in attendance.

This brief newsflash will focus on the primary reason for the SGM, namely for members to vote on whether only members who have contributed a minimum of R10 000 per sub-division/property within 14 days of the SGM and are prepared to enter into a debt repayment agreement which would result in their being fully paid members by end April 2025, will be included as members of LCAG. The vote SUPPORTED the proposal.

Whilst this will inevitably mean that the LCAG member base will shrink, unfortunately the LCAG cannot afford to carry non-paid up members, as we still have a long way to go to reach our required R3.2 million threshold.. On a positive note, there has been a substantive inflow of funds since the SGM and we welcome four new members. We hope to provide members with updated membership statistics at our forthcoming SGM towards the end of February 2025.

For those who were unable to be a fully paid member by 15 January 2025 but are able to reach the minimum membership subscription threshold of R10 000 and are prepared to enter into a formal payment plan which will result in their being fully paid members by end April 2025 should please contact Pedro Carvalho urgently (email accounts@broederstroomlandclaim.co.za contact number 0823370203).

Additionally, if you are destitute/battling financially and are unable to meet the minimum membership subscription threshold but are willing to enter into a negotiated financial plan you should also contact Pedro Carvalho to motivate your position and retain your LCAG membership.

Non LCAG member landowners have three options to defend their land from this claim:

  • Do nothing and wait for the court ruling. In accordance with the Act, taking no action implies that you accept the validity of the claim on your land and that you agree to it being offered for restitution to the claimants.
  • You appoint attorneys and defend your land personally.
  • URGENTLY contact Pedro Carvalho to negotiate a plan which will result in your being retained as a LCAG member and hence represented by our legal team at the court case.

We again urge members to please review their notices to ensure that they are fully paid members and that their contact/property details as provided are accurate. We also appeal to LCAG members to please engage with their neighbours concerning their status as a LCAG member and the accuracy of the information provided. Please ensure your Power of Attorney (POA) is signed and valid. Without a valid POA, LCAG cannot represent your property even if it is fully paid up. THE WAY FORWARD

Given the state of flux of arrears subscription monies being received as well as the need for our expert witness reports to be reviewed, another important Special General Meeting will be called towards the end of February 2025. At this meeting LCAG members will be appraised of special subscriptions required to ensure that we are able to fund our court case.

We reiterate that we are in the final hurdle of our 20-year-old-battle and are not prepared to trip up now.
