Good Day, all Members!

Our last Newsletter was published on 17 October 2025, and in this edition, we bring you up to date on events since then.

The Group's Annual General Meeting was held on 1 November 2025 at the Allengeni Wedding and Events Centre and was attended by 47 members, with 31 proxies submitted. The Chairman and the Treasurer addressed the meeting and presented their reports. A special agenda item related to the membership of Estate d'Afrique – more later.

In our last edition, we reported that another Pre-Trial Conference was scheduled for 14 November. These meetings with representatives from all the involved parties are convened by the Land Claim Court-appointed Judge to address procedural matters so as not to prolong the Court proceedings when the claim eventually comes to Court. So far, there have been 6 such conferences in 2024/25.

At the 14 November Pre-trial the notable events were:

  • The Legal Aid Board, representing the Claimants, again appointed a new Advocate;
  • The Claimant's new Advocate requested a 3-month delay in proceedings to allow them to familiarise themselves with the claim. The Judge denied this application and set a further Pre-Trial for 29 January 2026
  • • The NECSA property has been de-gazetted.

The Pre-trial set for 29 January did not take place due to the Judge's unavailability. It has been rescheduled for 20 February 2026. We sincerely hope that this will be the last and that the Judge will at long last schedule a date for a Court hearing.

Estate d’Afrique (EDA) Membership

EDA membership commenced in 2014, when they sought the support of LCAG to monitor and have input into the buffer zone around the EDA property, as they wished to protect the value of individual properties within EDA. The reason that they did not require membership or support for properties within the estate property was that they held a letter from the Land Claim Commissioner excluding these properties from restitution in respect of the land claim. However, in September 2024, the Commissioner's letter was deemed to have no legal effect, which necessitated EDA now having to include individual properties as members of LCAG. The LCAG Committee started negotiating a funding model to protect these individual properties. Some noteworthy outcomes included:

  • a meeting between LCAG Committee members and EDA representatives in January 2025 to discuss individual property membership;
  • In April 2025, the EDA representative resigned from the LCAG Committee.
  • Over the last few months of 2025, engagement has been between LCAG and EDA lawyers concerning the review of membership. The dispute between the LCAG Committee and the EDA representatives is in respect of the funding model, the provision of contact information for individual properties and the appointment of a representative to the Committee. LCAG gave them until 4 November 2025 to meaningfully engage and reach an agreement.
  • Shortly after the LCAG AGM, EDA through their lawyer suspended membership of LCAG.

LCAG has enjoyed a good relationship with the EDA representatives over the years. We continue to hope that we can amicably resolve this matter. However, individual property owners within Estate d'Afrique who may feel concerned about defence of the claim against their properties, are welcome to discuss their individual cases with LCAG.

Administration

  1. There are now 35 members who are still substantially in arrears on their subscription payments and are due to be terminated from membership. Individual accounts were sent out last week. We appeal to these 35 members to please bring their accounts up to date to avoid being terminated.
